Copyright and Ownership
Real Estate Projects
Sam Kroepsch Photography retains full copyright ownership of all media produced, including but not limited to photographs, videos, and any other visual content, in accordance with the Australian Copyright Act 1968. Ownership of the copyright remains solely with Sam Kroepsch Photography, and no transfer of copyright is granted to any client, agent, or third party unless explicitly agreed upon in writing.
Usage Rights
All media supplied by Sam Kroepsch Photography is provided under a limited, non-exclusive, non-transferable license. This license grants clients the right to use the content solely for the marketing and promotion of the specific property or project for which the photographs and/or video content were originally taken.
The work produced is not licensed for commercial use. If the work is intended to be used commercially, additional licensing is required from Sam Kroepsch Photography.
Relicensing
Should a property listing be removed, and the images or videos be required by another agent or agency, a transfer fee or a new license must be obtained from Sam Kroepsch Photography. The new license fee will be determined based on the intended use, distribution, and duration of use.
Raw Files
Sam Kroepsch Photography does not release raw files.
Restrictions on Use
The license does not permit resale, redistribution, or transfer of the media to third parties, including but not limited to other real estate agents, developers, or businesses.
The content may not be altered, edited, or manipulated in a way that misrepresents the original intent of the images or videos without prior written consent from Sam Kroepsch Photography.
Enforcement and Compliance
Any unauthorised use, duplication, or transfer of media without proper licensing will constitute a violation of copyright law and may result in legal action. Sam Kroepsch Photography reserves the right to enforce copyright protections and seek appropriate legal remedies for any infringement.
